Agreement to These Terms
These Terms of Use constitute an agreement between you and Forged to Serve Foundation (“Foundation,” “we,” “us,” or “our”) concerning your access to and use of forgedtoserve.org and related online services that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please discontinue use of the Services.
1. Our Services
The Services provide information about the Foundation, its mission and programs, opportunities to support the organization, and ways to contact us. Information on the Services is provided for general informational purposes and is not a guarantee of eligibility for assistance, funding, placement of a service or support dog, or any other benefit.
We may change, suspend, or discontinue any portion of the Services or any Foundation program at any time, subject to applicable law.
2. Intellectual Property Rights
Unless otherwise indicated, the Services and their content—including text, graphics, logos, photographs, designs, and other materials—are owned by or licensed to Forged to Serve Foundation and are protected by applicable intellectual-property laws.
You may access and print reasonable portions of the Services for personal, noncommercial use. You may not reproduce, distribute, sell, modify, republish, or commercially exploit our content or marks without prior written permission, except as permitted by law.
3. User Representations
By using the Services, you represent that you have the legal capacity to agree to these Terms, are at least 18 years old, will not use the Services for an unlawful or unauthorized purpose, and will comply with applicable laws and regulations.
4. Prohibited Activities
You may not misuse the Services. Prohibited conduct includes attempting to gain unauthorized access to systems or information; interfering with security or operation of the Services; transmitting malicious code; scraping or systematically collecting content without permission; impersonating another person or organization; submitting knowingly false, fraudulent, abusive, threatening, defamatory, discriminatory, obscene, or unlawful material; using information obtained through the Services to harass or harm another person; or using the Services in violation of applicable law.
5. Information You Submit
The website does not provide public user accounts, public comments, reviews, or other public posting features. You may, however, send information to us through contact, donation, application, or other forms that we make available.
You are responsible for the accuracy and lawfulness of information you submit. Do not submit information that you do not have the right to provide. Personal information is handled in accordance with our Privacy Policy.
6. Donations and Third-Party Services
Donation processing and certain other functions may be provided through third-party services. Those services may have their own terms and privacy practices. We are not responsible for the operation of third-party websites or services merely because we link to or use them.
Forged to Serve Foundation is recognized by the Internal Revenue Service as a tax-exempt organization under Internal Revenue Code Section 501(c)(3) and as a public charity under Section 170(b)(1)(A)(vi). Contributions are tax-deductible under Section 170, subject to applicable law and individual circumstances. Donors should retain appropriate records and consult their own tax adviser when necessary.
7. Service and Program Information
Descriptions of Foundation programs are informational. Availability, eligibility requirements, application procedures, funding levels, partnerships, and program scope may change. Submission of an inquiry or application does not create an entitlement to assistance and does not guarantee approval or participation.
8. Term and Termination
These Terms remain in effect while you use the Services. We may restrict or terminate access to the Services when reasonably necessary to protect the Foundation, our users, our systems, or others, or when we believe these Terms or applicable law have been violated.
9. Modifications and Interruptions
We may modify the Services at any time. We do not guarantee uninterrupted or error-free availability and are not responsible for reasonable interruptions caused by maintenance, technical problems, third-party services, events beyond our control, or changes to the Services.
10. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. To the extent a dispute is permitted to proceed in court rather than arbitration, the parties agree to venue and jurisdiction in the appropriate state or federal courts serving Tulsa County, Oklahoma, except where applicable law requires otherwise.
11. Dispute Resolution
Informal Negotiations
Before initiating arbitration, the parties agree to attempt in good faith to resolve a dispute through informal negotiations for at least 30 days after written notice of the dispute.
Binding Arbitration
If a dispute cannot be resolved informally, either party may require that the dispute be resolved through binding arbitration to the extent permitted by applicable law. Arbitration will take place in Tulsa County, Oklahoma, unless the parties agree otherwise or applicable law requires another location.
Arbitration will be conducted on an individual basis. To the fullest extent permitted by law, disputes may not be consolidated with another person’s claims or pursued as a class or representative action in arbitration. If arbitration fees imposed on a user would be excessive in relation to court costs, the Foundation will pay the portion necessary to prevent the arbitration requirement from being prohibitively expensive, as required by applicable law.
Claims concerning intellectual-property rights, theft, unauthorized use, invasion of privacy, requests for injunctive relief, and matters that applicable law does not permit to be arbitrated may be brought in a court of competent jurisdiction.
12. Corrections
The Services may contain typographical errors, inaccuracies, or omissions. We may correct or update information at any time without prior notice.
13. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, COMPLETE, OR ERROR FREE.
Information on the Services is not legal, medical, financial, tax, mental-health, veterinary, or other professional advice. Users should obtain appropriate professional advice for their circumstances.
14. Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FORGED TO SERVE FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED $500. Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Forged to Serve Foundation and its directors, officers, employees, volunteers, agents, and representatives from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, your violation of these Terms, or your violation of another person’s rights.
16. User Data

18. Miscellaneous
These Terms and any policies posted on the Services constitute the agreement concerning use of the Services. If a provision is determined to be unlawful or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Failure to enforce a provision is not a waiver of that provision. We are not responsible for delays or failures caused by events beyond our reasonable control.
